Terms of Service of www.herbaslovenica.si Online store
The Terms of Service are in line with Consumer Protection Act (ZVPot-UPB2).
www.herbaslovenica.si contains an online store that operates in accordance with the Consumer Protection Act. Purchasing items is possible without registering and logging in to the online store. To accelerate the procedure, the consumer can obtain a username and a password which will enable them to access their account every time they visit the website. The Terms of Service apply to the functioning of the online store, consumer rights, and the relation between the owner of the online store and the consumer. The Terms of Service do not apply to business users.
The provider undertakes to always provide the consumer with:
- company identity (name, address, registration number)
- contacts that enable fast and effective communication (e-mail, phone number)
- main characteristics of goods or services (including after-sales services and guarantees)
- item availability (each item or service, that is part of the offer, shall be available within a reasonable period of time)
- terms of delivery or performance (delivery method, place, time)
- all prices shall be clearly and unambigously defined; and it shall be stated whether they include taxes and delivery costs
- method of payment and delivery
- validity of the offer
- time limit and terms regarding withdrawal from the contract, as well as any costs of return
- clarification of processing complaints, including all information about the contact person or the customer service
Due to the nature of selling items online, the offer of the online store at www.herbaslovenica.com, owned by Sonja Vavken, s. p., is updated regularly and changes often and fast. Prices are stated as online prices. An online price is a price related to an online purchase.
Placing an Order
The purchase and sale agreement between Sonja Vavken, s. p., and the consumer in the online store of www.herbaslovenica.si is concluded as soon as the consumer receives a confirmation e-mail. As of that moment, all prices and other terms are fixed for both Sonja Vavken, s. p., and the consumer. The purchase and sale agreement (i. e. the first e-mail regarding the status of the order) is saved in an electronic form on the server of the company Sonja Vavken, s. p.
Online store www.herbaslovenica.si accepts the following payment methods:
- cash on delivery
- direct bank transfer to the account of the company Sonja Vavken, s. p. (offer/pre-payment). As soon as the payment is visible in our bank account, we dispatch items to the shipping address.
Issuing a Receipt
Sonja Vavken, s. p., issues a receipt that will be included in your parcel and where the price and all costs regarding the purchase are analysed.
The consumer is obliged to check the accuracy of the information on the receipt. We do not accept any subsequent complaints.
The provider is liable to payment of VAT, therefore all prices include VAT, unless if stated differently. Prices are valid on the day of purchase and remain so until cancellation. Despite the efforts to provide updated and accurate information, it can occur that price information is false. In such cases, the provider reserves the right to change the price while processing the order. The consumer will receive a written notification and will be offered the possibility of withdrawing from the contract, as well as a solution that will aim to satisfy both parties.

- Order received
After placing the order, the consumer receives a confirmation e-mail. The consumer can cancel the order within one hour's time. Detailed information on the status and the content of the order are available on the website at any time.
- Order confirmed
If the consumer does not cancel the order, the order goes into further processing when the provider reviews it, checks availability of the ordered items and either confirms it or rejects it for a reason. The provider may contact the consumer at their telephone number to verify the information or ensure the accuracy of delivery. Upon confirmation of the order, the provider notifies the consumer of the estimated time of delivery. At this stage, the sales contract between the provider and the consumer is irrevocable.
- Order dispatched
The provider prepares and dispatches goods within the agreed time and notifies the consumer via e-mail. The provider also informs the consumer about the return policy, as well as where to turn in case of delayed delivery and in case of complaint.

Purchasing items in the online store at www.herbaslovenica.si is not possible for legal entities. To place orders, legal entities shall directly contact the company Sonja Vavken, s. p.
Return and Exchange Policy
Purchased items that are unused, packaged, undamaged and in original packaging, can be returned and exchanged within 14 days of receipt. You will be required to pay the difference if applicable. The consumer bears the costs of return and postal costs of the delivery of exchanged items. They have the right to withdraw from the contract on condition that they notify the provider of their decision in writing within 14 days of delivery without giving any reason; and then return the items within 30 days of the notification of withdrawal. Returning goods within the withdrawal period counts as a notification of withdrawal from the contract. The consumer shall bear costs of returning purchased items. If the consumer intends to exercise their right of returning an item, they shall notify the provider in writing at email@example.com, and return the item within thirty (30) days of purchase or notification of withdrawal from the contract. Items must be unused, packaged, undamaged and in original packaging. Do not forget to add a copy of the receipt you have received along with the delivered items. The provider does not accept COD-deliveries. The consumer will receive a refund to their bank account as soon as possible, and at the latest within thirty (30) days of the notification of withdrawal from the contract, without claiming it.
Withdrawal from the Contract
With respect to distance contracts and off-premises contracts the consumer shall have the right to inform the company of their decision to withdraw from the contract within 14 days without giving any reason for such decision. In this case the consumer shall be liable to pay only the costs referred to in paragraph seven of Article 43d of this Act.
The consumer may inform the company of their decision to withdraw from the contract by using the form at this link or by making another unequivocal statement setting out their decision to withdraw from the contract.
The consumer is considered to have delivered the withdrawal statement within the time limit for withdrawal from the contract.
The delivery partner of Sonja Vavken, s. p., is Pošta Slovenije. However, Sonja Vavken, s. p., reserves the right to choose a different delivery service if they can process the order more effectively.
Personal pick-up by prior arrangement at Hotedršica 103 a, 1372 Hotedršica.
Shipping costs free of charge on orders over 40,00 (+ VAT).
Returns and Guarantees
The consumer can complain about an item if it does not have features the provider expressly promised; if the provider sent the wrong items, in a wrong amount, colour, or when it does not meet the consumer's order in any other way. The consumer can complain about the item within 14 days of purchase and request an immediate exchange for the same, impeccable item; request a reparation of the item or a refund. In case of complaint, contact us by phone at 041 414 919 or via e-mail at firstname.lastname@example.org. Our guarantee policy is in line with the Consumer Protection Act (ZVPot-UPB2). If the package the consumer received after having placed an order is damaged; if there is missing content or it shows signs of having been open, they shall lodge a complaint to the delivery service. Along with the delivery service, we will make sure the complaint will be resolved in the shortest amount of time possible.
In certain cases, www.herbaslovenica.si can require personal data which is necessary for our business performance. We use personal data for purposes such as purchasing items in the online store by online registration; participation in a play contest; informing registered users of promotional materials etc. We store data in accordance with the Consumer Protection Act, therefore we never sell it, rent it out or share it with a third party in any other way.
The consumer also holds responsibility for protection of their personal data by securing their username and password and by installing a suitable antivirus software to protect their computer.
The provider will contact the consumer by means of distance communication only if the consumer does not explicitly object it. E-mail advertisements will consist of:
- they will be unambiguously marked as advertising content
- the sender will be unambiguously identified
- actions, promotions and other marketing techniques will be marked, too, as well as the terms of participation in them
- it will be clearly stated how to unsubscribe from receiving advertising content
- the provider will respect the wish of the consumer not to receive advertising content
User Opinions and Comments
The provider is doing their best to ensure updated and accurate information on their website. However, features and prices of the items can change so fast that they do not manage to correct them. In such cases, the provider will inform the consumer of the changes and enable them to cancel the order or exchange the item. The provider is not liable for the content of the opinions of the items written by the users. Before publication, the provider reviews them and refuses those that are untrue, misleading or offensive. The provider is not responsible for information in the comments and is relieved of any liability regarding this matter. Even though the provider tries to provide accurate photos of items, all photos shall be considered symbolic. Photos do not guarantee the characteristics of items.
Complaints and Disputes
The provider complies with the current legislation (ZVPot). The provider does their best to fulfill their duty of setting up an effective system of dealing with complaints. The provider will inform the consumer of having received their complaint within five (5) working days, as well as let the consumer know how long it will take them to process it and inform them of the procedure along the way. The provider is aware that an essential feature of a consumer dispute, at least as far as litigation is concerned, is its disproportion between the economic value of the claim and the costs involved in resolving the dispute itself. This is also a major obstacle for the consumer to bring the dispute to court. Therefore the provider does their best to resolve any disputes by mutual agreement.
